Default Too weak-tight?

Party Poker 5/10 Hold'em (6 max, 6 handed) converter

UTG is properly aggressive preflop, but too loose. Say 40/14. Postflop he's aggressive but hasn't done anything tricky that I've seen.
CO is a LP fish.

Is this a bad turn fold? Is raising better than folding?
