mucked cards, call the floor?

**I know there's been a lot of "mucked cards -- rules?" posts lately. I did a quick browse through them and didn't find an answer to my question, so I hope this one is different enough that this isn't a useless post.

Last night, my gf is recounting her $2/$4 session at the Trop to me, and this hand came up:

She's dealt TT. Not exactly sure how all the betting went, but the board was [6c 7h 8d] Kh 6h in the end.

The dealer calls for a showdown between 3 players. One guy flips over Qh, leaves 2nd card face down. Other guy flips over J8o. My gf flips over her TT. The dealer declares her "tens and sixes" the winner, mucks the other cards, and starts pushing the pot towards her.

The guy who flipped over Qh starts to protest and says "I had a flush." The dealer says "I didn't see it." Some arguing occurs, and eventually the dealer fishes through the muck for his cards and pulls out Qh... and 5h. Dealer then declares him the winner and pushes the pot to him.

Now, I'm not sure how much certainty there was as to whether the 5h was really his 2nd card. I'm also not sure how relevant that is either way.

Also, I know that the Tropicana (I'm not sure if others do too) have a rule that says that even if cards are mucked, those cards can still win if there are witnesses at the table that can confirm it as a winning hand.

However, nobody saw his Q5h before it was mucked. And his cards were definitely IN the muck.

Therefore, I told my gf that she had every right to call the floor for a ruling. But I also said I wouldn't do it unless he was a jackass (to which she promptly replied that he kinda was).

I've never actually called the floor before, I know it's usually an unpleasant thing to do... so what's the right move here? Call the floor, or just let it go?

DEFINENTLY call the floor.. Demand that they look at the video tape to confirm the 5 [img]/images/graemlins/heart.gif[/img].

The pot is hers.

If it is in the muck it is dead. In is not the same as touching, mext to, against, partially in, etc.

Either the guy tried to slow-roll and got what he deserved, or he was deliberately cheating. Call the floor.

That was my original thought too, but upon saying this to my gf, she said that he really thought he had turned over both his cards. Or at least he said so.

Thanks for the responses, guys. In the end, she didn't do anything because she wasn't sure, and also she really doesn't like to stir up a fuss. And I wasn't actually there to say anything either. But I just wanted to know for the future, if we did call the floor in this situation that it wouldn't be a total dick move.

This is a great example of why it is so important to be observant at the table. I will NEVER flip over my cards if someone has flipped over just one card but not the other. I will ALWAYS ask them to flip over the other card.

You should never be shy about asking for the floor. Even if you are wrong they are generally more experienced in explaining a rule than the dealers.
