Default quick stud question

let's say we have a pot contested by three people.. and the high hand runs out of $ and goes all-in.. who is first to act? the next high hand? the first guy counter-clockwise from the all-in highhand?

Yeah, there are two accepted methods of handling it (and you listed both):

1) The high hand acts first, but since he's all-in he just checks. Action continues normally.

2) The all-in high hand is ignored completely until showdown, and first to act is determined normally amongst the remaining hands.

I've played at casinos that do it both ways. I seem to recall that one method is more common in the US and the other method is more common in Europe, but I can't remember which is which.

FWIW, in my home game we use method #1. It's more intuitive, I think. Just make sure that your home game has a set rule for handling the situation.
