This statement is completely untrue for the state of NY.

The ONLY time a home game here is considered illegal is if the house is taking a rake or charging a fee of some sort to play in the game. (as in a TOurney with $100 buyin where 90 is prize pool and 10 is the house. Or a $10 cover charge to walk in the door).

If you just have friends over and play straight up, without whoever is hosting taking a dime other then what they win legitimately playing in the game, it is 100% legal regardless of the stakes that are being played.
