legalities of online
I had heard somewhere that there had been a court case or two involving online gambling. The defendent(s) lived in a state in which gambling was illegal, but claimed that the bet they were making was actually in Costa Rica or Canada or wherever and therefore not breaking any laws (since the server actually taking the bet was in said countries). Anyone know anything about this?
thanks, j.k. |

Re: legalities of online
Yes, that has been the opinion. The actual Gambling takes place where the server is located.
However, if you are talking about Sports Bets, the transmission of any information to facilitate making a sports bet is a violation of the Wire Act, and so that would still be illegal no matter where the Server (and the actual gambling) is taking place. |

Re: legalities of online
The more modern state laws ban not only gambling, but the "transmission of gambling information." Bottom line is it depends what state you live in.
