Re: Scammed by a 2+2er
Sorry to hear about this. This is very unfortunate because sometimes you think you know someone better than you do and believe that you can trust them. My thought on this is that when you start noticing that the guy is becoming a little 'shady' it is time to call it off and get paid as soon as possible.
And for all of you saying this is a waste of space, it was the only way for the staker to get a hold of the obviously ashamed stakee after tilting in the step 5s. If the guy is not responding to any of the other forms of contact, this is the most efficient way to get the lowlife to respond or have his 2+2 credibility run through the mud. And this also lets other people know about this individual who may try to get staked again. This thread is a warning for all to be aware of this low life and others that may try to pull this crap too. It also just shows that there are d-bags out there that really don't give a sheet when not dealing with someone face to face. I think the OP has learned from this experience and I know others have too. |

I don't understand why he owes you 3000. You gave him 1700 and 50% of 1700 is 850, so he owes you 2550. Is the other 450 there because he is paying late? [/ QUOTE ] good grief... 57 |

[ QUOTE ] Watch yourself or you may wind up in prison. Ask a lawyer but I think threatening to publicly expose someone unless he pays up is extortion. The fact that the story may be true doesn't matter. Nor does it matter that you are collecting a valid debt. Blackmail is not a legally acceptable debt collection tactic. [/ QUOTE ] Yet another one of the dumbest things I have ever read, thanks 2+2. [/ QUOTE ] Then you don't read much... there are plenty of much dumber things said on 2+2. 58 |

I don't understand how telling someone that you intend to use your freedom of speech to honestly report on someone renegging on a deal is 'blackmail' or 'illegal'. [/ QUOTE ] It isn't. But threatening to expose him unless he pays is. I've excerpted the California Penal Code as an example of state law. Highlighting is mine. 518. Extortion is the obtaining of property from another, with his consent, or the obtaining of an official act of a public officer, induced by a wrongful use of force or fear, or under color of official right. 519. Fear, such as will constitute extortion, may be induced by a threat, either: 1. To do an unlawful injury to the person or property of the individual threatened or of a third person; or, 2. To accuse the individual threatened, or any relative of his, or member of his family, of any crime; or, 3. To expose, or to impute to him or them any deformity, disgrace or crime; or, 4. To expose any secret affecting him or them. |

Re: Scammed by a 2+2er
Dude, are you saying that if you borrow money from me and tell me to blow when I ask for it back (or ignore me) and I say: pay up or I will tell your friends you welched...that it is a crime? And moreover, that a court would actually convict me?
I would be very interested in reading an actual case where someone was convicted under similar circumstances. Do you think one actually exists? Another way to look at this is that he is exposing fraud. |

This is much different from asking for money and in return not exposing some secret. |

Re: Scammed by a 2+2er
all of the law-stuff I know is from Law and Order.
But it seems like this could be a parallel (just like Jack McCoy would say) with someone saying "pay me the money...or I will smear your name in all papers." or "pay me the money or I will tell your wife (or tell the newspapers) we are having a homosexual love-affair." whether it's true or not it's extortion, right? Jack McCoy would certainly make it so. |
