Well, if congress has a problem with how a court rules, it is free to over ride the court. The only exception is when the cout rules that an act of congress exceeded congress's constitutional authority.

Furthermore, congress wouldn't have the power to regulate everything under the sun the way it does if the court hadn't allowed it carte blance under the commerce clause.

Nothing you have posted says that US judges are meant to create law.

Your citing of the California Civil code actually PROVES the opposite, it made Common Law, Code.

You claim I do not understand the issue. I claim it is you who does not understand.
