Default Angle shot or honest mistake???

I'm playing in a $100 Sattelite and its down to three. the villian is in the 1 seat, the "next guy out (NGO)" is in the 2 seat, and I am in the 4 seat. I get involved in a hand with the NGO- he bets, I raise him all in, and he then places the rest of his chips in a neat stack near the pot but also within reach of the villian in seat 1. I win the hand, NGO gets up, dealer starts to push me the pot, and at the same time, villian grabs the neat stack (that should have been pushed into the pot) and places it right on top of his stack of chips!!!!!

I immediately protest that those are my chips but now there is really no way to know exactly how many were there. The villian has a somewhat sheepish look, throws some chips out and says "was it about that much?"

I like to give the benifit of the doubt here, but it sure could have been a shot at me.

Anyone dealt with this one before?
