From Robert's Rules of Poker

Under "Ties"

5. If two or more hands tie, an odd chip will be awarded as follows:

(a) In a button game, the first hand clockwise from the button gets the odd chip.

Thats why we were confused. It seems to be given to the person with the best position as long as they arn't the dealer.

The guy who I was arguing with was saying that it should go to the person out of position always.

I just wonder why the dealer never can get the chip. Also in the casino's I have routinely seen the dealer give it to the person with the highest suited card. However, I noticed that the rules specifically say that this is not supposed to be the case.

I agree with jzpiano here, we leave it in the pot for the next hand. Many players at home games aren't aware of all the rules and will not be happy if someone else get the chip when their hand was just as good. Since most game are just for fun everyone is happy to leave it in the pot most of the time.

Now if your game aren't just for fun and you don't agree with that then it's the responsability of the host to maintain a book of rules and make sure that everyone understand it. I wouldn't like a home game with that kind of competivity though...home games are suppose to be fun beyond winning money.
