Default Roberts nomination means nothing

Democrats will be idiots if they try to put up any resistance to Roberts' nomination. Although O'Connor was a swing vote in many repsects, she was primarily conservative. Roberts' appointment will not drastically change the composition of the Court and Dems will only make themselves look like obstuctionists if they put up a huge fight against Roberts. IMO all that matter is if Stevens is able to stay alive until 2008.

maintaining the court is one thing but what if they want to change it in their favor when taking office?

Let's talk about how Roberts replacing O'Connor will change the court. Here is a list of cases decided by 5 to 4 with O'Connor joining the liberals in the majority. Roberts may have changed the outcome in each case by joining the conservatives instead:

McCreary v. ACLU (2005)
Jackson v. Birmingham Bd. of Education (2005)
Tennessee v. Lane (2004)
Alaska Dept. of Environmental Conservation v. EPA (2004)
McConnell v. FEC (2003)
Grutter v. Bollinger (2003)
Stenberg v. Carhart (2000)
Davis v. Monroe (1999)
