[/ QUOTE ] This is most likely correct. As long as you do what's in your power (tell the judge about the discrepancy), you've done your part. If you didn't say something, then you'd have no forum of grief for the system failing. |

Hi slamdunkpro,
I was a criminal defense attorney from 1993-1999 (I practice another type of law now), and can assure you that the defense lawyer in the case would be very interested in hearing what you have to say. Just because you were subpoenaed by the state doesn't mean you have to sit by quietly. What the lawyer will do is just call you to the stand again as part of the defense's case. Good luck! |

Update – received another subpoena today and was informed that the judge declared a mistrial based on questionable testimony and discrepancies in the time line. The subpoena was from the defense attorney for a discovery deposition.
