I guess attempted murder isn't a crime.

He had the note, he had a gun(although it is a cap gun), so intent can be surmised.

He's going to be convicted, as he should. This went beyond just thoughts.

if a cop saw him pull up to the store, and pull on a ski mask/stocking- if the cop arrested him right there i think he should be convicted.
