I think this is a grey area and an interesting question. I'd like to hear what some of the experienced floormen on this board would do in this situation (ignoring the fact that its an off-duty dealer, since that shouldn't matter).

What if we knew that the third player was signaling the lag dealer that he had a really strong hand? Is this collusion, even if the lag dealer doesn't get any money for his efforts?

In general, can it be collusion even if the colluding parties don't share in the profits in any way?
