Default Extradition

I've seen a lot of posts on this issue. And it applies to many more people and situations then the one I'm about to list. And I actually think what has happened with refusal to extradite to the Iraqi government is a much worse offense. Nevertheless, I think the following example will hit home for Americans.

If all of a sudden one of the PC European countries captured Osama Bin Laden but refused to extradite him what should the US do. Let's assume he gets the slap on the wrist Milosevic treatment.

Edit: I suppose if only US people would respond it would make more sense.

The US would be pissed off to no end. It depends on the nation though, if Italy or Germany got em we'd be hard pressed to do much, but if somehow romania came about capturing bin laden I think the navy seals might "accidently" break him out.

They'd go along with it. There's enough anti-American feeling in the World without them putting sanctions on innocent allies.

Default Another Condition

What if in addition to no death penalty he couldn't be incarcerated in an American jail or tried in an American court. I put etc. after death penalty, but I don't want people to think that's the only thing that might be insisted on.

The main issue they have with us is the death penalty. I'd be willing to forego that that put him on trial here. Executing him would be of minimal value, anyway. It's not like Al-Qaeda would disappear, and those guys like having martyrs.

I'd even be willing to change venue to the Hague and do it in the World Court, as long as the prosecution team could be from the US.

It's not like the guy is ever going to be a free man. The trial has been long, but largely because it's a war crimes tribunal in disguise. Are you arguing that anything short of execution is a "slap on the wrist."

I think it is highly unlikely that any of the European countries, except perhaps France, would not extradict Bin Laden to the states. It is also highly unlikely that any of them would ever capture him, so I don't think its something we have to worry about too much.

We should be able to choose multiple options. I vote for accepting conditions and imposing sanctions both.

After a lengthy trial he'll get to live out his days in comfort. Facilities include Serbian television, a gym, a recreation room, and an outside courtyard. Even foregoing the death penalty. it's not like he's going to pound me in the ass prison in America.
