Default Why checks still exist

A lot of people still like having the control over making payments from their checking account instead of using ACH transactions and auto-pay or using online banking. You'd be surprised at how many companies still cut payroll checks instead of using direct deposit. If you have to send payment to someone who doesn't have a credit card machine or an online account, what else are you going to do?

The Check 21 Act is moving banks to a more electronic system if they choose to participate. This may become mandatory in the near future. Basically, when a bank receives a check for deposit, it scans the check's image and uses the routing information to complete the transaction electronically. Instead of sending the actual check through a clearinghouse to the account holder's bank, the check is scanned and destroyed. Float time is cut down considerably, which helps catch check kiters. Of course, this is great for the banks because they have a more accurate picture of their available funds and can invest them accordingly. If the customer wants to see the cleared checks, they are given image printouts or substitute checks instead of the actual check.

Hope this helps.

Start working for a bank, and then pull one of these "data-input mistakes".

You might try putting cement mix in their washing machines.

OT: Why do checks still exist.

Surely you have just as much control making a transfer using an ATM. When I hear about all the hassles involving checks it just strikes me that the simple electronic transfer is so much more cut & dried. I'm in Japan where checks have never really existed and you never have to hear "the check's in the post" - either the money's been transferred to your account or it hasn't.

Your mom got caught kiting checks. Bummer. She's lucky they don't send her ass to the pokey.

[/ QUOTE ]

It's not kiting if there's money in the account the check is written from. She's doing a very simple transfer from one account to another via check and they decided to hold the check...huge difference dude.

Assuming you believe him.

When I was a kid my Mom opened a saving account for me. After a while I stopped using it but had left $1.14 in it. The bastards closed my account and took my money and I still hate them for it.

[/ QUOTE ]

I canceled a bofa account when i was 18 after withdrawing everything from it. They later made an interest payment into the account and kept it open instead of actually closing it. Of course my account had a 1k min balance (hence the interest payment). Like a year later i found out they hadn't closed the account and that after this interest payment they started charging me an underbalance fee. So now i had an overdrawn checking account and some some stupid amount in the hole. A frustrating amount of time on hold for a phone call i never should have had to make and a week later i received my check for 1.18, after all charges to the account post my closing it were reversed. I never bothered cashing it. BofA is definitely the worst bank i ever did my banking with and i'm glad i switched at 18 instead of some point later when they could have really [censored] me over BofA style.

follow the bank manager home one day, then tie him to a chair and make him watch as you rape his wife and children. Then kill his dog and steal steal the remote to the TV.

Fast forward to a couple weeks ago, my mom (who uses the same bank) is out of state and goes to a branch of this bank to deposit some money. She has a checking account at a different bank in our home town that has no ATM card, so she frequently writes checks to herself from the local bank to the evil bank. She has done this multiple times and the money was instantly available to her. She deposits $5k and everything seems to be normal, but a couple hours later, checking out at a grocery store, her ATM card is declined. She calls the bank and there is a 10 day (!) hold on her check. They never told her there would be a hold at the bank.. just let her drive off and attempt to go shopping. The next day she goes to the bank to try to work out what the problem is (remember, she is out of state with almost no money), they tell her they CAN'T TELL HER why they are now holding her checks, and they refuse to work with her in any way to get her at least some money. So that day my mom is forced to call her friends and family and ask to borrow money for the trip.

[/ QUOTE ]

Here's your play, assuming you have all the correct facts. They told her the hold was 10 days. By law, maximum hold is 5 days, in some cases 1 day. File a federal complaint. Nothing like having to deal with the federal governement to mess up your day.

The law/regulation governing this is set by the Federal Reserve. It's Regulation CC, found here. Check it over to make sure they violated her rights (and I think they needed to make $100 available in 1 day), then fire away.

Original article I found was here, it might be useful as well.
