Where I play, if you don't have cards (ie you mucked them) and there is a contest over the pot, you are SOL.

You simply do not give back your cards until the pot is awarded. Since you still have your cards and the other player does not, you get the pot.

The fact that the dealer is miscalling hands should make that practice even more obvious.
