I was a semi-pro eBay seller for a few years, and from what I can tell the auction is legit, and any state that recognizes eBay auctions as binding contracts (which most do now) would honor it. HOWEVER, including an inaccurate picture is a violation of eBay Terms of Service, even if you say "it looks nothing like the picture" which this seller did. eBay may then decide that it is an invalid auction and remove it from their (public) servers, then it would not be valid.

I think we just had a thread with a link to an auction that sold an email address like xbox360@yahoo.com or something similar. The text clearly stated that you weren't getting an xbox360--you were getting the password to a yahoo email address, which you could use as your own.
Since the auction ran the same day the XBox was released, he got about 100 bids, that ran up $800. |

I suspect a lot of the bids are people simply BIDDING because they want one. Once they actually WIN it, they read it and find out it was bogus, and just never pay up.
Another guess is that some of the bidders don't know english very well, which is very possible. |
