Default The System Fails

NOT A HURRICAN POST – NOT BUSH”S FAULT

I was subpoenaed to Court today as a witness in a DUI case. I’ve testified in court many times as a witness from my firefighter/EMS days and also as an expert witness in other cases.

In most cases the street cops have told the truth with their side in a favorable light but this was the first time (where I knew all the facts as a witness) where the street cops actually perjured themselves. Not lies of omission but actual fabrications.

It was very disappointing.

Actually I waited until a recess was called then asked the marshal (Federal Court) to let me see the judge. The judge is having a meeting with the prosecutor and the defense attorney this afternoon. I guess I’ll get another subpoena.

I dont think there is much you can do though, it's a you said, they said kind of thing. Even though you are right, I bet he will side with the police. Nothing wrong in trying though.

The short version is I was the first person on the scene of a single car accident. I called 911 and went to render aid. The events that the cops described either didn’t happen or were vastly different from what I saw.

Yeah, it's probably going to be a he said-cop said thing, but there are EMS and hospital logs that are different from the police deposition.

DUI is the hot ticket right now. They want a conviction on top of their DUI arrest.
