Default Rules in this situation ?

Ok, following happend in our home game yesterday:
Seat 1: Goes ALL IN.
Seat 2: Thinks......
but while he thinks ;
Seat 3 says: fold and shows his hand.
Seat 1 then mucks his hand. (He forgot about seat 2 who is still "in the hand")

???? What should we do ????

Not enough info. It's either 1's fault for not noticing 2 or it's 2's fault for not protecting his action. 3 is just a douche.

If player 1s hand is irretrievably mixed in the muck the pot has to go to player 2. Player three needs to be warned about acting out of turn (if he has already been warned then it may be time to stop inviting him since there really isn't anything else you can do to him.)

If the cards that player 1 had are clearly identfiable then give them back to player 1 and let player 2 act. (I do not subscribe too the magical muck theory that just because cards touched the muck they can't be retrieved). Clearly Player 1's mucking was caused in large part by Player 3's action and Player 1 should be penalized because Player 3 can't follow the rules.

Problem is, if you let it slide, then the next situation comes up and somebody else wants to let it slide. Rules are rules. Next time #1 will keep his cards. Lesson learned.

Like I said, a friendly game, I would let it slide. A game that is played all the time with the same guys and its competitive thing, then no it should be a lessoned learned situation.

You can enforce the lesson without punishing #1. If they can be retrieved, and this has NEVER happened before, take the cards back out and let #2 decide.

Warn everyone that mucked cards are dead cards, even if retrievable, for the next time.
