I was on the jury of the trial of which the above is a transcript of the appeal. We voted for death. Read what this guy did.

[img]/images/graemlins/cool.gif[/img] This guy certainly sounds awful, and this would probably be the type of crime that I would suggest the death penalty for if I supported execution in general. Our society probably wouldn't lose much or anything from his death (discounting monetary costs of execution vs. prison time), but I don't see it benefitting society or the victims. Thus, life in prison without parole would be my preference.
I wouldn't hold it against anybody for wanting this guy dead. I don't know how it works in reality, is it 100% up to the jurors or are there guidelines to follow that they need to decide based on?

I really can't answer without the original trial transcript and an understanding of what aggravating factors are necessary in Georgia to condemn a man to death.
That said, I probably wouldn't have been on the jury in the first place.

Guidelines were 'particularly horrible circumstances' (or something to that effect), torture was involved, (we deemed psychological torture of the mother, she had to listen to her children being attacked while she bled out upstairs), crime was during the commission of another felony, some other stuff I don't recall.
(I was fairly PO'd to end up on the jury myself, I was #12 and believe I was a defense pick after prosecution ran out of 'dings' as I had a fairly anti-law enforcement background... needless to say it backfired on the defense)

Given those guidelines, I think that it seems like in this instance, the death penalty was warranted in accordance with Georgia law, so if I were on the jury, which I'm sure I wouldn't be because of my personal beliefs about the death penalty, I would have to vote to execute.

I'm terribly dumb with regards to this, so more questions. Are jurors expected to decide without taking into account personal feelings about the death penalty itself? If so, I think I'd likely suggest death for reasons similar to what you gave.

Voir dire was pretty heavy on death penalty attitudes, though potential jurors who voiced anti-death penalty beliefs got a pretty thorough going over. I suppose the court knew there would be a large number of potentials who would try to use it. The jury pool had 600 people. 12 jurors and 4 alternates were selected.
I felt pretty ill when I heard my number called.
