Default jack-king off on 5/10 NL Party

I have about $1400 at the table, villain has me covered. He plays a little looser than the average TAG, and is a solid, winning player.
I raise from one off the button to $40 with JK off, everyone folds to the villain who quickly calls out of BB.
Flop comes AAQ rainbow.I bet $30, villain min-raises, I call.
Turn comes a 10, putting two clubs out there. I check, villain bets $125, I min-raise to $250. Villain instantly goes all-in. Should I call or fold?

I'm confused. Why are you acting first if he is in the big blind and you are one off the button? unless the whole jack-king off was the whole point of your post.
