Online poker legal throughout Europe?

I recently found out I`ll be in Germany for a while and was wondering about the laws pertaining to online poker/gambling. Similar laws as in the US?

Illegal for German residents because it is considered tax fraught. If you are not a German resident you are legally safe.
If you are a German resident you are practically safe since it is not enforced.

In most european countries (UK aside) it is an a-legal activity, and in theory taxable. However, after several meeting with tax experts, chances of getting in trouble for not declaring your online poker winnings is very close to zip.

Yes, it's tax free in UK as far as i'm aware.
