Default Working at Coke and drinking Pepsi

So I have a friend who works at coke and he told me that if he gets caught drinking Pepsi (or any other of cokes competitors). While he is working he would be fired. I’m not sure on how this works but is this legal? He wants to quit soon so I told him to test the waters and then talk to a lawyer about it. Should he try this or will he lose the case?

I'm pretty sure you can be fired for any reason that isn't a legally protected one like age, religion, ethnicity etc...My boss can fire me if he doesn't like the sort of music I listen to.

He should contact Pepsi maybe for legal support? They'd kill for the publicity.

I have a sneaking suspicion that a company as large as Coke may have possibly investigated the legal ramifications of this policy.

Yea that wouldnt be a bad idea since one of the managers offered him a job before.

Yea the difference is the coke company he works for is family owned. I guess there isnt to many of them around anymore. Not sure if that makes a difference.

I worked onsite at motorola for a bit, if you didnt have a motorola handset you had to hand in your phone at reception and were not allowed to use it in the building.

Stupid policies made by stupid people imho.

A more positive was working at Tropicana they kept a big fridge full of drinks for us for free, included Pepsi as I think they must make it under licence, as well as some belgium lager.
