Default Empire/Party Terms & Conditions: No One in United States Is Safe

18. Forfeiture, Account Closure and Confiscation.

Company reserves the right, in its unfettered discretion, to void any winnings and confiscate any balance in your EmpirePoker.com account (and any ESP account or Company related account including other websites and casinos owned or operated by Company) in any of the following circumstances:

1. If you have more than one active account at EmpirePoker.com;

2. If the name on your EmpirePoker.com account registration does not match the name on the credit card(s) or other payment accounts used to make purchases at EmpirePoker.com;

3. If you participate in a EmpirePoker.com promotion and withdraw before fulfilling the requirements of that particular promotion;

4. If you provide incorrect or misleading registration information;

5. If you are not of legal age;

6. If you connect from a jurisdiction where participation in the Games is prohibited by law;

7. If you have "charged back" or denied any of the purchases or deposits that you made to your Account;

8. If you are found cheating or attempting to cheat, or if it is determined by Company that you have employed or made use of a system (including machines, computers, software or other automated systems) designed specifically to defeat the system or you are found to have colluded or attempted to collude with other players of EmpirePoker.com in order to defraud the Company;

9. If you have allowed or permitted (intentionally or unintentionally) someone else to use your Account;

10. If you fail to comply with any of the terms and conditions of use set forth in this Agreement;

11. OR
If Company should become aware that you have played at any other online gaming site under any of the circumstances set out at i) to x) above.

As you can see, given the "illegality" of gambling in the United States via online means, they can just close your account and take your money at anytime. Granted, the U.S. represents a HUGE portion of their revenue stream, so it's doubtful it would happen....but it COULD happen.

And given the recent issues with people having accounts closed because of software that is used (I haven't tried PokerEdge, but I do use PokerTracker Omaha, which doesn't provide me with a means to "cheat" other players, but it's all in the eye of the beholder sometimes)

Hey, great, more tinfoil bullshit to pollute the forums with.

Can we just make one big mega thread for every retard who thinks online poker is rigged or that the sites are looking for a way to pack up and run off with their $48.34 account balance?

This [censored] is out of hand, but I guess its nothing new for the zoo.

Online porn is illegal in most jurisdictions too, but I don't see that industry worrying too much. Between that and gambling they are probably the two largest money makers online.

Default In Regards To Using Other Software

6. Artificial Intelligence.
We are committed to detecting and preventing software programs which are designed to enable artificial intelligence (non-human) to play on our site. Such programs are often designed to send information about cards, dice or players to an external program. Information sent to an outside program is not permitted.

The company will take measures to prevent and detect the use of such programs using methods including but not limited to screen scraping or reading the list of currently running programs on a player's computer.

I believe they meant "screen capping" not "scrapping"

Still, it looks like, especially with their recent "software upgrade" that they are aggressively pursuing people like us.

Whether or not my use of Poker Tracker Omaha and PokerAce Hud will result in my account being closed down, I can't say. I hope not, I just got started with all this online poker playing. [img]/images/graemlins/frown.gif[/img]

I'm just bringing this part up because of the recent spate of issues with the use of software to assist players with record keeping, table selection, etc.

The Party network just did an "upgrade" to their servers, and given that they are not based in the U.S., it is a little scary to think of accounts being closed. I decided to look at their T&C to see exactly what was said, so I'd know what the deal is with the use of Poker Tracker and other software.
