We recently (a year or two ago) passed a law making it illegal for a "gambling business" to accept bets over the internet. The first bet accepted is a Class 6 felony, and each subsequent bet accepted is a Class 5 felony. Each individual bet is a distinct crime under our law. The funny thing is that the state claims (by legislative fiat) that this law applies if the bet either originates or terminates inside the boarders of SD, so that technically our state has claimed the right to put our boy Dikshit away for something like a bazillion years. Of course that doesn't apply to individuals like me, but under state law, making any wager that isn't specifically designated as legal by the state gaming control board is illegal and a Class 2 misdemeanor. That applies to internet gambling, private home games, NCAA tourney pools, etc. Obviously this is unenforced. Many states have laws like this. |
