In all honesty, you should both be at minimum severely reprimanded. You moreso as his supervisor.

Steve... I like your posts a lot, I always get a kick out of you. But this time you went to far, you placed yourself and your company under great liability with your statements. I haven't read the full thread yet, but here are my notes for you. I suggest you take my advice seriously, this is not a joking matter.

If your employee is smart, he will find a lawyer willing to work under contingency for this case and start suing for a living. He will make far more from his case than he would at your job, and the odds are in his favor (especially if he had any witnesses, or if he discussed it with any coworkers after the incident).

Your solution is as follows:

1) Call your boss IMMEDIATELY and tell him everything that happened. Put it in writing as well, so you have a documentation of the encounter.

2) You must be reprimanded for your actions, and the other employees in the company must be aware that this took place. Oddly this is good for your supervisory meta-game in the long run, subordinates respond better to management when they know they are not above the law

3) You must provide a written apology, including a statement that says you were not representing the company at the time of your actions. This absolves the company of liability (and lets you keep your job... I'd fire you in a second otherwise if I was your boss to show that the company took action) and places all liability on you personally. Since from past posts it seems that you live a meager to average life financially, the chances of him finding a lawyer willing to take the case is slim to none.... hence there is a 90% chance you will be safe from litigation.

I wish you luck my friend, I know you didn't mean harm and it was started because of your worker's bad attitude, but the potential for damage is too great. Do the right thing..
