Well the next day, Ben walks in and I ask him if he will empty all the trash cans at the cubicles because it was not done the night before. Now he was not the first person to arrive that morning but he was the first male employee(besides myself to arrive that morning.)

I do not ask the female employees to take out the trash because the dumpsters are around a blind corner at the end of the building and it backs up to the railroad tracks and we have drunks and bums on occasion back there Dumpster Diving.

He responds "So queers can pack the (Crap) but they can't carry it out?" others heard him say this so I fired him on the spot for creating a hostile work environment and then had the ones that heard his comment write up a personal description of the events and I put them all in a file for the personnel office to go in his permanent record.

Homeless people do not perform violent acts any more often than the public at large. You should not be afraid of bums.

Statistically, men are more likely to be the victims of violent crime than women.

Change your policy and make everyone take out the trash. Also, don't punish the people who arrive to work early by making them do extra chores. Distribute the responsibilities evenly.

He was out of line to say that, but you didn't give him any sort of warning before firinng him? How was his actual job performance? Did he get along with the other employees?
