The way it's played out all three times I've seen this come up is like this. The dealer reaches over and takes the guys cards and the guy IMMEDIATELY screams. The dealer calls the floorman over and says, "I accidentally took this players cards. They're right here." He points to the cards that hit the muck. The floorman asks the guy to write down what his cards were. The guy does so. The floorman looks at what the guy wrote, and looks at the cards. They match. The floorman returns the cards to the guy, and play continues as if the dealer had not screwed up in the first place. There could not be a better result.

Following up my own post. I should mention that I called the floorman over. Since that was the very first bet I had made in that club, and since it was unusual that verbal declarations not be binding, I expected him to rule in my favor that one time only. When he didn't, I politely walked.

I laughed when I heard, "you must protect your hand at all times"...which is true, but sounded incredibly familar to a boxing match.....
