There are far many more Whataburger chains than In-N-out chains.

In-N-out is far superior in taste and better ingredents over all. The Whataburger menu is good, 24/7 open, and more menu items. You see a whataburger in TX as much as a McDonalds or JackintheBox.

Plus you are missing the one key things. All in-n-outs have no freezer in their stores. . Their food is trucked in daily. Thats why most stores are near the freeway. They have way better shakes also.

You would lose any economy of scale you get from more franchises because of the whole freshness thing. Can't buy a bunch of meat in CA and have it prepared fresh in FL.

I think.

Hasn't been mentioned yet, I think the owners are religious fanatics. Or something like that. There's a bible verse referenced on the cups.

You are starting from a faulty assumption.

As it happens the entire In-N-Out franchise is family owned. They believe that going public or offering franchises would put their quality control at risk, and therefore they limit their outlets.
