I personally think that the guy who couldn't read his cards was the real cheater here. And the dealer is a cheater as well. And so am I for those awful cheating-style posts I wrote earlier supporting cheating in all forms. So There!

I would split the pot b/c not having this on my conscience is more EV than the 25 bucks or whatever.
Edit - although I would also split it if it cost me 2500 dollars or any other amount. |

I wouldn't go so far as to call it cheating, but I personally would definitely be recorrecting the dealer. If I were in reach of the board, I would push the cards myself to illustrate why we should be chopping. Being a "nice guy" at the table is +EV. I never softplay anybody, but if I've established myself as a likeable and nice guy, other very often will, e.g. checking through river they would've bet, folding when they're drawing when they should be calling, etc. I got friendly with this one guy who was a huge fish at the Commerce 20 game and every time he won a pot for the rest of that session he would toss $5 to me. The next weekend I was at his table again and he did the same thing. Call it karma, common sense, EV, whatever, but this kind of stuff will pay you back.

If the game is bad enough, this structure is probably beatable. Given the quality of your opponents, and the dealer in this example, I suspect the game is very beatable.
Split the pot. You are probably going to need the same ruling on the other side at some point, or more likely, you will have AK, against K3 on a KJJ73 board, and you will have to explain why you get the pot, so get this hand right, and it will help you get the others right in the future. And splitting the pot is right, and you know that, or you wouldn't have had enough doubts to post this. |
