I haven't downloaded any stuff like that (other than a small amount of porn, but I doubt that would raise any red flags)

[/ QUOTE ]

Someone please correct me if I'm wrong but I don't believe it is a violation of copyright to download protected materials, only to upload them. I think all the MPAA and RIAA lawsuits have been against uploaders, not downloaders. I'm not sure I'd want to get into an argument with my cable company about the semantics of that difference but it might be a factor if you are sued.

[/ QUOTE ]
OK. You're wrong.

The general law is that you cannot make a copy of copyrighted material without permission of the copyright owner. Downloading is definitely making a copy.

There are a variety of exceptions in the law that allow copies without permission for certain purposes. But none of these normally apply to taking a five finger discount on an entire movie.

Holy sh$%^$t, I called my cable company to find out why my internet wasn't working. I thought it was a late bill perhaps. The lady says it's because of abuse and transfers me to tech sevice. I'm thinking, Oh boy, here we go!!!! So the tech lady says "Did you download the movie "The Italian Job" because we got a report from the MPAA that someone at that account downloaded copyrighted material. I'm thinking, that's it! I'm toast. But she basically said that as long as the movie is removed from the computer and I am aware that the cable modem account could be terminated if done again, then they will reconnect.

whew!!!!

wow - was this a torrent put out there by the industry to catch and warn people??? Has anyone ever had this happen to them?? Just so you know , I got it from Demenoid.com.

This isn't quite correct. It is a violation of copyright law to d/l or upload any copyrighted material. However, the MPAA has focused much of the lawsuits on uploads, especially those who upload a ton. That being said, it doesn't mean that a person who downloads a single song or movie cannot be sued.

I find it curious that your ISP contacted you and disconnected your service given the Supreme Courts decision in the Verizon case. The court held that ISP's don't have to give names to the MPAA or anyone unless there is a John Doe suit filed first to get your name. You should find out if such a suit was given or if the ISP voluntarily gave out your name. Like Granny said, if they are giving it out voluntarily I would change ISP and tell them the reason you are changing is b/c you believe in the concept of Due Process. No reason for the ISP to give over this information since it just costs them time and money they don't need to exert. Tell them to read the Verizon case as well if they don't know like they should.

What a crappy movie to illegally download. It's on like 10 times a day on cable.

[/ QUOTE ]

Which might explain why the cable company isn't happy about you downloading it using their equipment.

Thanks for that clarification. I was pretty sure I'd read that all of the MPAA/RIAA lawsuits so far have targeted heavy uploaders and I must have assumed that the underlying copyright law was the reason for that.
