[ QUOTE ]
It's entrapment if the police trick a law abiding citizen into committing a crime. Things such as befriending a person and then asking them to commit a crime as a favor are entrapment.

[/ QUOTE ]

It is not quite that simple.

First, the idea for committing the crime came from the government agents and not from the person accused of the crime.

- Second, the government agents then persuaded or talked the person into committing the crime. Simply giving him the opportunity to commit the crime is not the same as persuading him to commit the crime.

- And third, the person was not ready and willing to commit the crime before the government agents spoke with him.

On the issue of entrapment the government must prove beyond a reasonable doubt that the defendant was not entrapped by government agents.

Some guy got busted who used yayo, said Mike knew all the big players in town, so a narc befriended Mike and acted buddy buddy with him for many of months, then asked him if he could get some yayo for a mob guy who was in town, Mike said yes, they busted him for trafficking. The case was so airtight, they plea bargained it down from 25 years to 6 months. If he actually fought it hard he probably wouldn't of had to spend anytime in jail.

he recieved an amount of money for an amount of cocaine, even though he was not a drug dealer per se, how the [censored] could this be entrapment?

do some of you just spout whatever legal term pops into your head before you speak?

[/ QUOTE ]

How is it entrapment? Well, if an undercover officer befriends you for over a year and then asks you to get him some coke for the sole purpose of busting you for dealing once you get him the coke, that would seem to be the definition of entrapment. Without the undecover agent initiating the drug deal, there would have been no crime. Of course, given court rulings over the last two decades, entrapment is almost non-existent, but to just dismiss the claim is ignorant.

I'm a lawyer, so I hope I can get away with using legal terms. From the press accounts, there's nothing to suggest he would NOT have had a valid entrapment defense, although we don't know everything of course. As a prior poster noted, the fact that he was allowed to plea-bargain an otherwise serious crime down to 6 months is pretty strong evidence that the prosecution felt there would be some serious problems if they took it to trial.
