Exactly what I was thinking, I'm actually disappointed that I couldn't be the first one to point that out.

Its a bad picture. You really can't see anything. Don't make judgements based on it.

As a life rule, don't judge people at all! (That's hard to do though.)

I've perfected my 2-second assessment to the point that I know whether or not I'll get along with someone in... 2 seconds.

Has to be in person, though.

anyone else see the e-mail she sent to the site:
Bryan (micon),

> For the general understanding of how the courts proceed with copyright
> law, I will explain. According to Lexis Nexis:

> "You do not need to apply or
> register to have a copyright; you receive copyright protection when you
> create the work...The instant you use your pencil, typewriter or
> computer to produce something original it is subject to copyright
> protection provided it is a copyrightable subject matter."

> Examples of work that already have copyright protection include:

> (1) literary works
> (2) musical works, including any accompanying words
> (3) dramatic works, including any accompanying music
> (4) pantomimes and choreographic works
> (5) computer databases
> (6) pictorial, graphic, and sculptural works
> (7) motion pictures and other audiovisual works
> (8) architectual works
> (9) sound recordings

> Please forward this information to your attorney. I do believe in
> this situation, my "copyright" is witheld in the sixth category.
> As stated clearly in copyright law, "Contrary to the wording, however,
> whether materials are public has no relationship to whether they fall
> into the Public Domain. This mistaken notion has somehow led many to
> believe that everything on the Internet is public and therefore in the
> Public Domain and thus freely usable without permission. This is
> completely false.(1)"

> I have clear documentation of copyright law regarding internet
> procedure that states: "The URL address is copyright protected. And if
> someone uses an image they own as a link to their site, it too is
> copyright protected...You will have to have permission to use an image
> from a site if you wish to add a link to that site at your own site.
> You can add links to any site without permission though, just don't use
> their image for the link." For example just putting a link to
> http://jenn1c1de.tripod.com is found to be legal, however, posting
> images from that URL is found to be illegal.

> Nevertheless, whether or not something is "fair use" is rarely a clear
> yes or no question. It requires review of case law and the above
> factors by an experienced attorney who can assess the level of risk
> involved in the proposed use.

> After reviewing the material that is provided above, please consider
> this as a warning for I am fully prepared to take legal action in this
> matter. I am submitting my final and second request to remove
> these pictures from http://www.neverwinpoker.com. Please feel
> free to have your attorney contact me or my attorney in advance to
> court proceedings. If you need my attorney's information, I would
> be more than happy to provide it.

> Yours truly,

> Jennifer

Jen, nice job if you actually wrote this. A lot better than the crap many of my fellow law students could produce.
