I definitely think that the prosecutors are gonna have an easier time than the defenders with this one. It's possible a judge might dismiss the attempted armed robbery charge, but I don't think a jury would let the guy walk. They have self interest in seeing a guy like this behind bars. There is a reason the conviction rate is in the high 90%'s. Would any reasonable person doubt that he was in the middle of a robbery attempt? I think that's a pretty good line.
