no the prosecution wont...they have to PROVE something...the defense does not...its not gonna be such an easy case

Exactly. It's possible a judge might dismiss the attempted armed robbery charge, but I don't think a jury would let the guy walk. They have self interest in seeing a guy like this behind bars. There is a reason the conviction rate is in the high 90%'s.

Would any reasonable person doubt that he was in the middle of a robbery attempt? I think that's a pretty good line.

The attempt was not made. Perhaps he was tempted to attempt. But he did not attempt.
