A check is not a call of a wrong amount and most places will allow you to fold or raise if you accidentally say check.

Zen,

I don't beleive that that is correct, but I understand your reasoning. There are 3 possible actions when it is your turn. Call, Fold, or Raise. A "check" is simply a call of a $0 bet, or a call of the minimum bet if the player has already posted that bet blind. (In the BB or joining a game). This situation is the same as if it is post flop, a player bets $10, there is a caller, another player raises to $50, the fourth player says call and tosses out $10 in chips. If it is obvious that the player was not aware of the raise in front of him, most dealers or floormen in a casino would allow the player to fold instead of calling the raise.

If you check out of turn, you will not be allowed to bet or raise when the betting comes to you next. You will be allowed to call or fold. I think the same rule should apply here.

Where is the BB acting out of turn?

Actually a check is announcing a NON BET.
and I think allowing him to fold is absolutly correct when facing a raise. On the other hand, Allowing him to raise is wrong for the same reason, he's already expressed an interest in not putting money in play.

Dunno how you guys play, but at our game, verbal declarations are binding. And he CLEARLY DECLARED A NON BET. Now if you really wanted to be a nit about it, you could say he wouldn't even be allowed to call. just so he wouldn't be able to profit from this angle shot.
After all, he's already declared a NON BET.

This is correct. The floor would also rule in this case that he could only call since he threw out less than 1.5 times the bet to him to make it a valid raise. Anything else would be a string raise.

To the OP, your case is a bit diffenrent and the player should have the option to call, fold, OR raise since checking is not a valid option. Sililar to if it was checked around and someone says "call" right after putting chips into the pot. This is a bet, and the player can not remove it and must meet the minimum bet requirements.

It's not quite the same situation. To be the same situation, the guy who tried to call with $10 would then say raise and put in $100. Would a B&M casino allow that?

No, other posters already correctly established that no raise would be allowed.
