OOT rules - piracy?
About 30 minutes ago I created a thread entitled "I just deleted my entire porn collection by accident" in OOT, and I ended my post with something like "I'm going to be putting my broadband to use in the next few days.. any suggestions?"
Within a minute, Astroglide (OOT mod) deleted the thread and sent me a PM stating I was violating the OOT piracy rule, which states: [ QUOTE ] 2+2 is a private business, and this forum is an extension of it. 2+2 publishes copyrighted material for profit, and is specifically concerned about the possibility of their products being electronically stolen. they are also not interested in defending a lawsuit if a copyright holder goes after them because of a link in a post. finally, the forum is financially supported by advertising, and it would be difficult to attract an ad for something like a poker dvd if piracy discussion is occuring. nobody's buying the "but i use it to download FREE AND LEGAL things" bit either. simply don't talk about it. [/ QUOTE ] Honestly I don't know how I fall under this rule. I was not soliciting BitT0rrent links, as he implied that I did, nor did I mention/encourage any use of piracy tools/methods. I don't see how this is any different from MP3 discussion/suggestion threads, but he thought otherwise and decided to give me a *. I think he used very bad judgment by both deleting my thread and giving me a *, but I wanted to get a second opinion. Anyone? |

Opinion: Not Guilty.
I don't see, from this post anyway, that you've mentioned anything about swapping or pirating copyrighted material(s). I'm assuming you didn't mention the questionable software - kaaza, etc. Your mention of using your broadband, IMO, suggests you're going to legal sites and purchasing material for your enjoyment/use, as per the terms of the site(s) you visit. Or, you use one of the Usenet services, which are absolutely loaded down with non-copyrighted multimedia files - or so I've been told. [img]/images/graemlins/wink.gif[/img] I understand 2+2's policy and concern. The mod was acting in the best interest of 2+2 - in his opinion. His opinion was maybe hasty. Unless you two have "a history," it's probably just a misunderstanding. Some of the mods, IMO from personal experience, seem to act a tad overzealously. The opinions expressed by the expressor are strictly his. And I have a very good understanding of copyright laws. I hold a few. Anybody can. |

I PM'ed Mat in hopes of having this situation rectified. |

Astro is an unbearable zealot on this issue. I got two stars for one OOT post about piracy. You can talk in great detail about every illegal activity concievable by the human mind in OOT, but if you make a reply like: "I d/led a soundtrack off p2pSoftwareX and didn't like it because..." you are scum and a breath from ban. I hope he gets gored by a boar.

Disclaimer: look at my title, I guess I'm a hypocrite
Opinion: Not guilty of the top count, possibly guilty of a lesser included charge. No actual request for links to pirated material = not piracy. IIRC the forum can only be liable if live links to copyrighted material or sites hosting such copyrighted material are posted and not removed when reported. If the post was as you say it was, and I say that only because I didn't see it, and you requested names of material to put in this collection, and not sources to steal it from, then the deletion may still have been justifed, but IMHO the * was not. If I were in astro's position, I'd be far more likely to find a way to * you for a NSFW violation, not piracy. Then again, the way Astro worded his rule there, technically telling someone to go to Walmart and steal a DVD is an offense.... [ QUOTE ] Astro is an unbearable zealot on this issue. In defence of Astro, the rules are (now) plainly stated and explained. It's up to people to make sure they're followed, and also to avoid starting discussions that may lead to breaking the rules. This is from someone who got a star for discussing file sharing programs, and Astro was very reasonable about the whole thing.
