A little known fact about Stevens:
He grew up as a Republican, his father was a Republican politician. He has stated in the past that he wants to replaced by a Republican President. We may think of him as on the liberal side of the court, but like Whizzer White on the Democratic side, Stevens has taken his party affiliation seriously. I hope the justices do retire together rather than spreading the retirements out because it'll be harder for the Reps to get multiple conservatives this way. I'm sure some self-righteous poster will dispute this fact in a knee-jerk fashion, but the Washington Republicans are openly worried about it.

Why would it be harder?
Either the GOP has the votes and the commitment to apply the nuclear option or they don't. If they have enough votes to get one nominee through, they have enough for 2 or 3 nominees. |
