Proper action should have been: You check, he pushes, you muck. Same difference.
I assume if you got the floor, the dealer would have said you checked, and he bet (I know you didn't, but you know what the dealer was going to say...).
The ruling you wanted? That you could check and he had to check behind you because he had acted out of turn? You wanted a free card?

Well I eventually got a floor over after the hand was over and he ruled that I had the option of killing the betting for the rest of the hand or making him go all-in. So I could have essentially made him check the hand down or honor his all-in. We both showed our hands after I folded and the hand calculator on card player said the percentages were 49.7% vs. 50.3%...I had 88, middle pair on a J high board and he had an open-end straight draw and flush draw

look it up, it really is 49.7 vs. 50.3
would have been a hell of a showdown
