I just googled Lysander Spooner. He was a 19'th century figure who argued that the constitution is without authority. I only read the first paragraph of his argument, but I imagine that by extension he didn't believe in the nation-state or any other method by which people bind themselves together inter-generationally. (Being obtuse is one of my less endearing qualities [img]/images/graemlins/tongue.gif[/img]) Treason is, of course, meaningless if you don't accept anyones authority over your own person.

Would Lysander agree to a mandated constitutional convention every 20 years if everyone had the right to nominate the delagates and each contentious issue was put into a format where the entire nation could vote on them, individually?

[/ QUOTE ] This was a half joke. Basically, Spooner's most famous work is "No Treason", hence the (possibly lack of) humor. To answer your question... No, by voting individuals in the populous are inherently imposing their will on everyone else. Delegates would also have the government granted power to impose their will on others, Spooner would be very against this. He is for individual sovereignty, not popular. |

As you already noticed, one of his objections to the US Constitution was that nobody alive had signed it - people today are actually expected to be held to a contract that was drawn up before they were born. However, he would also object on the grounds that even in the time it was acutally adopted, it was forced upon people who did not explicitly agree to its terms. It's right there in the opening: "It has no authority or obligation at all, unless as a contract between man and man." |
