Default Question about a ruling

5 handed HE , in a casino . No body move the puck after the last hand & both SB & BB post their blinds ( BB didn't realise he was the BB the last hand , & same for the SB ) . We are all dealt our 2 cards , & UTG fold . I am next to act , then , the BB notice "our" mistake .

Is it too late , since there was an action ( UTG fold ) ? What is the rule ?

Sometimes "action" means a call or raise pre-flop. So, this may still be a misdeal.
