How long in advance did they know? Also, say Empire told shareholders what was going to happen 2 weeks in advance. Well, the stock probably still falls the same amount so they aren't helping out their shareholders. IMO it was pretty easy to see that there were pretty good odds on something like this happening, but Empire was trading at a similar valuation to party and ignoring the risk for the most part.

Kane - while I have not seen the filings for Empire, I would almost guarantee that this potential event was decribed in the "Risks" section of the Company's statements.
