Man exonerated for rape now suspect in murder
This is a big deal in Wisconsin, don't know if anybody else has heard about this, so I thought I'd pass it along.
Here's the backstory: 2 years ago, a group of law students, using DNA evidence, proves the innocence of Steven Avery. He had served 18 years in prison for a rape he didn't commit. A few days ago, a woman goes missing. Her car and the remains of an unidentified woman turn up in Avery's family's junkyard. Here's the story. JSOnline article Assuming he did it, should he be sentenced to time served? What about the group that freed him, should they feel guilty? |

Assuming he did it, should he be sentenced to time served? [/ QUOTE ] He should be executed. His previous time served is irrelevant. [ QUOTE ] What about the group that freed him, should they feel guilty? [/ QUOTE ] No. They had no way of knowing what he'd do... assuming he really didn't commit the rape. If he did*, then yeah, they suck. * Note: The fact that he was "proven" innocent doesn't necessarily mean that he didn't do it... just as the fact that he was "proven" guilty didn't necessarily mean that he did it. |

The fact that he was "proven" innocent doesn't necessarily mean that he didn't do it... just as the fact that he was "proven" guilty didn't necessarily mean that he did it. [/ QUOTE ] Actually, DNA evidence from the woman showed that another man, who is currently serving time for another rape, is the person who raped her. Avery did not rape the woman he was originally convicted of raping. |

Assuming he did it, should he be sentenced to time served? [/ QUOTE ] No, you can't "bank" wrongful jail time agaisnt a future crime. If he is innoccent on the rape charge, he can a should sue for wrongful imprisonment, but one has nothing to do with the other. |
