I don't expect the federal government to prosecute anytime soon:

1. It's bad politics because gambling is popular and widely viewed as victimless.

2. Their legal case is very shaky. Prosecuting someone for speech and advocacy is not impossible but it's very touchy. The legal theories in this situation are pretty untested. Plus the standards of criminal law might easily allow the defendent to worm out of something that might have stuck in a civil action.

3. If the government should lose then they have set the precedent that the law is not on their side. All the big media companies and banks they intimidated may decide there is nothing to be afraid of after all.
