Remember, the Supreme Court has ruled that virtually everything affects interestate commerce. I remember Justice Breyer arguing that a law about not bringing guns close to a school was valid because of the interstate commerce clause.

Anyway, as far as your point about the BCS being unfair. The 6 major conference winners get a bid (seems fair), and 2 at large teams, this year it will be Ohio State and Notre Dame. Both top 10 teams.

If a 6-5 team gets a bid over a 10-1 team, then we could talk about unfairness, but I really don't see anything that terrible here. That being said, I would like to see an 8 team playoff.
