Common sense has yet to stop a lawsuit. If I'm the casino, I do the same thing. It's just the way life's gotten. "Frivolous" is not part of many plaintiff's lawyers' vocabularies.

This is an uninformed statement. Good lawyers evaluate cases in terms of expectation. Many cases have almost no upside, and a lot of downside (cost + potential malicious prosecution lawsuit).
