Inform the police. They probably won't bother investigating it, but at least you would have done your part.
It's most certainly the bartender. I've heard many stories of bartenders who are paid off by men to slip date rape drugs in drinks. Women have gotten vigilant about watching their drinks once they have them, but they seldom think to watch the bartender as he's preparing the drink in the first place.
