But - and this is my live-game-newbie ass talking - isn't it possible that floor could be seen as making decisions that favor players who toke? Would a casino possibly be guarding against that?

I read in Greenstein's book where he recommends toking the floor if they let you in on a juicy game, and I've gotta say that if I'm sitting in and I see Barry Greenstein coming my way, I'm gonna be a little pissed off at the floor.
