7 justices found that the recount was unconstitutional. If the recount is unconstitutional, then there must be a remedy. Oral arguments began Dec. 11 and the Electoral College (by law) must vote Dec. 18. And the state had to choose its six electors six days before the 18th (the next day). So either SCOTUS could conduct a new statewide recount and break the law or go with the certified results. 5 justices agreed to do the latter.
