i hate to say it but i really think that like padilla US citizen enemy combatant case and the handful of cases are really test cases.
bush is in many circumstances (gitmo bay cuba) saying, hey , judiciary has no say in matter (and he has congress in pocket),
but
if he can get the courts to actively participate then it cannot be called illegitimate and they can roll it out in a wide scale.
