it's the state laws.
and the individual state has to legalize it via popular vote or in the legislature or whatever.

for example - efforts to try to get casinos in Ohio have been shot down once or twice. so there's nothing on the ohio river between Ohio and Kentucky (or up on Lake Erie either).

It has been leagl in Indiana for several years though...so there are a couple casinos near the Cincinnati area on the Indiana side....as well as down in the Kentucky area....and up in Gary, Indiana too of course.


Within the state it sometimes can be up to the individual county to approve it also.
In Mississippi they are legal in Tunica County......about 35 minutes from Memphis. But they were not approved in Desoto County (5 minutes from Memphis).
So all the Memphians have a longer drive to get to the nearest casinos because Desoto doesn't want them. They sure do make up for it by nailing all the speeders to and from though.

When I dealt BJ in Mississippi I was licensed by the Mississippi Gaming Commission and was subject to their rules and regs. I also had to pay $120 fee I think just to get my license in order to leagally deal (the license has to be showing at all times on the casino floor when working)
